Privacy Policy
CRAFT, confirms, accepts and irrevocably warrants that we shall:
1. Not disclose or otherwise make available the Personal Information to any third party other than authorized staff or sub-contractors who require access to such Personal Information strictly in order to carry out their obligations pursuant to our obligations to “The Client”.
2. Ensure that our employees, agents, subsidiaries, representatives, subcontractors and any other persons that have access to the Personal Information are bound by appropriate and legally binding confidentiality and non-use obligations in respect to the Personal Information
3. Comply with the provisions of the prevailing privacy and data protection legislation governing the collection, use and processing of Personal Information as defined in the relevant legislation.
4. Only act on the instruction of “The Client” in collecting, processing and utilizing Personal Information.
5. Not process Personal Information for any purpose other than to perform our obligations to “The Client”, and to ensure that such processing will not place The Client in breach of any privacy and data protection laws or stated requirements. Take appropriate, reasonable, technical and organizational measures to ensure that the integrity and confidentiality of the Personal Information in our possession, or under our control, is secure and that such Personal Information is protected against accidental loss, destruction, damage, unlawful access and / or processing.
6. Immediately notify “The Client” in case of possible infringements of the applicable data protection legislation, the terms of this agreement or other irregularities by ourselves, our staff of any other party acting on our behalf in relation to the Personal Information.
7. Return or destroy the Personal Information once it is no longer required for the purpose of performing our obligations to “The Client” or any directly related purpose; and fully indemnify and hold “The Client”, its affiliates, associates, subsidiaries and their respective staff, successors, cessionary and assigns, harmless from all and any losses, costs (including but not limited to legal costs on an attorney and own client scale), expenses and damage (including but not limited to consequential losses and damages)
as well as penalties and fines arising out of, or relating to any non-compliance with the provisions of this agreement and any relevant data protection legislation.
8. Only transfer Personal Information across a country border with “The Client” prior written consent. In this regard, you shall ensure that any such transfer of any Personal Information across country border complies with applicable laws.
The obligations contained herein above shall continue after the termination of our services to “The Client”, for whatever reason.
Any breach of any of the provisions of this agreement shall be regarded as a material breach of our obligations to “The Client”.
Your data protection rights:
• You are entitled to access your personal data by sending a written request to info@craftloyalty.co.za – We may charge you a fee for this service as set out in terms of Condition 8 of POPIA.
• You may also request CRAFT to correct or supplement any of your personal data which CRAFT will undertake as soon as practicable.
• Request the destruction of your personal data. Our Information Officer will consider your request in light of any other laws or regulations prohibiting CRAFT from destroying your personal data.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
